LIABILITY POLICY

1. Introduction
This Liability Policy outlines the terms and conditions for the photography services provided by Forever114Graphics, owned by Aaliyah Lang. By engaging in any photography services with Forever114Graphics, clients acknowledge and agree to the terms and conditions outlined in this policy.

2. Scope of Services

Forever114Graphics specializes in both graphic design and professional photography services. Our photography services include, but are not limited to:

• Portrait sessions (individuals, couples, families)

• Event photography (weddings, parties, corporate events, etc.)

• Product photography

• Headshots and branding photography

• Photography for social media or marketing purposes

3. Client Responsibilities

To ensure smooth execution of services, clients must agree to the following:

• Timeliness: Clients are required to arrive at least 10 minutes prior to the scheduled shooting time. This ensures that everything is set up and ready to begin the session promptly. If the client arrives later than the scheduled time, the session may be shortened accordingly, and no refunds will be issued for lost time.

• Outfits and Props: The client is responsible for providing all outfits or any other items for the shoot that have not been specifically discussed or confirmed with Forever114Graphics beforehand. Any additional items brought on the day of the shoot that were not pre-approved may result in time delays, and Forever114Graphics cannot guarantee their incorporation into the session.

• Materials & Preparation: The client is responsible for ensuring that all necessary items for the shoot, such as outfits, props, or any special equipment, are ready and available at the scheduled time. Forever114Graphics is not responsible for any items that the client forgets or fails to bring.

4. Copyright, Ownership & Use of Images

• Ownership: All images captured during a photography session remain the property of Forever114Graphics until full payment has been received. Upon receipt of full payment, the client is granted a license to use the images for personal and commercial purposes, unless otherwise specified in the agreement.

• Image Rights: Forever114Graphics retains the right to use all images for promotional, portfolio, and marketing purposes unless explicitly stated otherwise in a signed agreement.

• Third-Party Licenses: If third-party licenses or releases are required (for instance, model releases, location permits, or use of copyrighted material), it is the client's responsibility to secure these before the shoot. Forever114Graphics will not be liable for any legal issues related to third-party rights.

5. Limitation of Liability

Forever114Graphics is committed to delivering high-quality photography and design services. However, Forever114Graphics shall not be held liable for:

• Loss of Images: While we take every precaution to ensure the safe storage and delivery of images, Forever114Graphics is not responsible for any loss of images due to technical issues, data corruption, or other unforeseen circumstances. Clients are encouraged to make backup copies of their images.

• Client's Use of Images: Forever114Graphics is not responsible for any damages or legal claims arising from the client's use or distribution of images, including infringement of intellectual property rights or unauthorized use of third-party material.

• Delays or Disruptions: Forever114Graphics will not be responsible for any delays or disruptions due to circumstances beyond our control, such as inclement weather, equipment malfunctions, or unforeseen emergencies.

6. Revisions & Cancellations

• Revisions: Clients are entitled to two rounds of image revisions following the delivery of initial proofs. Any additional revisions will incur a fee of [insert fee here].

• Cancellations: If the client cancels the session with less than 48 hours' notice, a non-refundable deposit will be retained. If the client cancels with more than 48 hours’ notice, the deposit can be transferred to a new date, provided that rescheduling is possible.

7. Photography-Specific Policies

• Punctuality: Clients must arrive at the agreed location at least 10 minutes before the scheduled shoot time. This ensures that the session begins on time and allows time for any last-minute preparations. Late arrivals may result in a reduced session time without a refund.

• Weather Conditions: For outdoor shoots, the session may be postponed or rescheduled if weather conditions are unsafe or unsuitable for photography (e.g., rain, snow, extreme heat). The decision will be made at the discretion of Forever114Graphics, with client input.

• Image Delivery: Final images will be delivered in high-resolution digital format. The typical turnaround time for delivery is [1-3 weeks] from the date of the shoot, but this may vary depending on the complexity of the project. Rush delivery options are available for an additional fee.

8. Indemnification

The client agrees to indemnify and hold harmless Forever114Graphics and its owner, Aaliyah, from and against any claims, liabilities, damages, losses, or expenses arising from the client's use of the photographs, including any claims of copyright infringement, misrepresentation, or privacy violation.

9. Non-Compete & Confidentiality

Both parties agree to respect each other’s proprietary and confidential information. Any materials, ideas, or business plans shared during the session or design process are to be kept confidential. Additionally, Forever114Graphics agrees not to disclose personal information of the client to third parties without explicit consent.

Acknowledgment and Acceptance

By proceeding with the booking of any photography by Forever114Graphics, the client acknowledges that they have read, understood, and agreed to the terms and conditions laid out in this policy.
